Background

Katie Tornari is a Senior Associate in the Insurance and Reinsurance Department at Marshall Diel & Myers. Katie Tornari qualified in 2001 at Edwards Angell Palmer & Dodge UK LLP (formerly Kendall Freeman) in London after completing her training with that firm. Katie works on a range of complex insurance and reinsurance disputes.

Katie has significant experience in handling large insurance coverage disputes in arbitration and, in particular, disputes concerning the Bermuda form. Katie also has extensive experience of arbitrations which have addressed various complex highly contentious London market issues for both solvent and insolvent reinsurance companies. Katie has acted for clients in the live market and clients that are in run-off, including Lloyd's corporate members.

Katie is the Education Officer on the Bermuda Insurance and Reinsurance Under 40s Group.

Notable Experience

  • Katie has recently acted for a Bermudian insurer in an arbitration against its insured relating to a Bermuda form policy.
  • Recently assisted in the preparation of Schemes of Arrangement for the companies in one of the largest pools there is by number.
  • Has obtained a number of awards in arbitrations for various clients, including members of major underwriting pools, on issues relating to recoverability of claims and the fundamental issue of the burden of proof under reinsurance contracts.
  • Awards that Katie has obtained for clients have contributed to the successful acceleration of their run-offs and/ or the closures of their Schemes.
  • Acted for a major insurance company in an arbitration relating to issues arising from its relationship with a telecommunications mutual association and was involved in advising on the impact on the arbitration of the reinsurer going into administration in Guernsey during the course of the arbitration proceedings.
  • Successfully opposed a number of applications for permission to appeal London arbitration awards and has successfully enforced London arbitration awards in New York under the New York Convention.
  • Involved in advising clients seeking to collect reinsurance claims on the formulation of a pre-litigation strategy and avoiding limitation period difficulties.
  • Has been extensively involved in drafting, negotiating and advising on complex settlement and commutation agreements.
